Lawsuit to Determine Accountability

The families of victims killed and injured in a nightclub fire in Rhode Island are looking to a massive civil lawsuit for accountability. Almost 300 injured victims or relatives of those who were killed have filed suit. The fire was sparked by a rock band’s pyrotechnics, which set flammable soundproofing foam ablaze.

Wal-Mart Class-Action Suit Set For Trial

A class-action lawsuit alleging Wal-Mart Stores Inc. secretly manipulated electronic pay records and refused to pay overtime is set for trial next month. The lawsuit has grown to 65,000 current and former Wal-Mart employees who claim the retailer docked their pay. This lawsuit is among 70 similar state and federal cases.

False Advertisement Suit Against Diet Pill Manufacturer Settled

Consumers of "Dr. Phil" McGraw’s diet products will be eligible for refunds or replacement vitamin supplements as part of a $10.5 million settlement. The discontinued "Shape Up!" products were made by CSA Nutraceuticals and included shakes, bars, and vitamins. McGraw will not be personally liable for the settlement, which may cover more than 100,000 people.

Overcharging For 401(k) Fees?

Lawsuits throughout four states allege seven companies allowed outside firms operating 401(k) plans to overcharge their employees. According to the plaintiffs’ attorney, employees overpaid millions in management fees often hidden in obscure agreements. The seven firms combined have over 400,000 employees participating in the 401(k) plans.

Policyholder Refunds

America International Group Inc. will begin refunding or crediting its Florida workers compensation policyholders with a $13.6 million settlement. According to the commissioner, the agreement was prompted by charges that the insurer’s business units "used excessive and unfairly discriminatory rates on coverage required by the federal Terrorism Risk Insurance Act" and failed to justify rates. AIG will also pay a portion to the Florida Office of Insurance Regulations as part of the settlement.

Whistleblowers Sued by State Farm Contractor

An insurance adjusting firm who contracts with State Farm Insurance Co. is suing two sisters who blew the whistle on State Farm’s denial of claims after Hurricane Katrina. E.A. Renfroe & Co. alleges the women broke the law when they submitted internal State Farm records to an attorney. They accuse the sisters of violating the Alabama Trade Secrets Act and breaching confidentiality agreements with the company.

Another Win for Merck

A federal jury found for Merck this week in another lawsuit over Vioxx. The jury ruled that there was not enough evidence to link the drug to a Kentucky plaintiff’s heart attack. There are 14,200 cases still pending nationwide over the drug.

Murphy Oil Settles Class-Action Suit

Murphy Oil Corp. will pay $330 million to settle a class-action lawsuit filed by Katrina victims. Plaintiffs claimed their homes and businesses were damaged by the 1.1 million gallons of crude oil that was carried in floodwaters. The spill occurred in a suburb of New Orleans and caused some of the worst environmental damage from the hurricane.

Prison Guard Sues Over Mistreatment-Retaliation

An ex-State prison guard alleges he was hazed by co-workers and stabbed outside his home after reporting the incident. The plaintiff claims he was harassed and labeled a snitch for "breaking the code of silence." The retaliation followed the plaintiff when he transferred prisons, forcing him into early retirement.
