Another Fatual DUI
A newly filed lawsuit seeks unspecified damages from a former surgeon who was driving a sports utility vehicle that rammed into a car killing a pregnant school administrator and her 10-year-old daughter.
The crash an associate principal of aHigh School, and her fetus. Her daughter, a fourth-grader at another school, died later. A 12-year-old son survived with minor injuries.
Another child who was with them survived but deserves damages because of permanent injuries she suffered, according to the lawsuit.
The lawsuit also states that the husband of the woman killed deserves money for the "past and future loss of society and companionship" of his wife and their unborn baby.
The physician has been charged with three counts of homicide by intoxicated use of a vehicle.
Authorities say the doctor, who has three previous convictions for driving while under the influence of intoxicants, plowed his SUV into the rear end of the victims’ vehicle that had stopped for a red light.
Prosecutors have said that the doctor also took a combination of prescription drugs prior to the accident.
Defendants in the lawsuit include the doctor and two insurance companies.
