Mother Files Wrongful Death Suit Against Tavern

A Montana woman has filed a wrongful death lawsuit against the tavern her daughter was working at prior to her death in an alcohol-related car crash. According to the lawsuit, management at the Windsor Bar in Boulder, Mont. encouraged Dallice Smith to drink on the job then allowed her to drive despite knowing she was intoxicated. The case is scheduled to be heard in Jefferson County District Court in Boulder.

Wrongful Death Suit Filed Against Cab Driver

A Chicago family has filed a lawsuit against a cab driver and the company that owns his car after the cab driver hit and killed one of their family members last month. The Chicago Tribune reports the cab swerved across a few lanes of traffic and struck the 57-year-old man, who was walking down the sidewalk. The suit claims the cab driver and the taxi company were negligent and failed to exercise care and caution that “a reasonable person under similar circumstances would have exercised.” The suit is seeking unspecified damages.

Hotel Heir to Pay $4.9 Million for DUI Wreck

Hotel heir Barron Hilton will pay $4.9 million to a former gas station attendant in California who was hit by Hilton’s car during a drunk driving accident in 2008. When Hilton was arrested, he had a blood-alcohol-content level of 0.14 and was 18 years old. The attorney for the man injured said he suffered permanent disabilities because of the incident.

Suit: Non-Working Stoplight Caused Fatal Crash

A Houston, Texas, woman has filed a lawsuit against CenterPoint Energy, claiming the company and others are responsible for a two-car accident that killed her eight-month-old daughter in May. According to the lawsuit, the stoplight at the intersection where the accident occurred was not working due to maintenance by the company, which led to the accident. “The sole reason this accident happened was because they didn’t advise anyone nor did they take steps to control the traffic once they turned out the lights,” the plaintiff’s lawyer told the Houston Chronicle. The suit is seeking unspecified damages.

San Diego Settles Suit over Motorcycle Death

The city of San Diego has agreed to a $1.8 million settlement with a local family over the death of a motorcyclist in April 2009. The lawsuit claimed the city could have prevented the accident by installing a traffic signal at the intersection where the incident occurred. Records show that a dozen accidents occurred at that intersection between 2006 and 2009.

Salt Lake Family Receives Settlement in Car Crash

The family of a Salt Lake City man who was killed in a car accident in March 2010 has settled a lawsuit with the driver who caused the accident. According to the suit, Efrain Torres ran a stop sign and struck the vehicle driven by the victim, who died of injuries sustained at the accident. Per the settlement, the family of the victim will accept “the policy limits offered by Efrain’s insurance companies,” the Salt Lake Tribune reported.

Jury Awards $2.69 Million in Fatal DUI Accident

A West Virginia jury has awarded $2.69 million to the families of four people killed in a fatal drunken driving accident in 2008. The man responsible for the accident, who was sentenced to six to 26 years in prison, stole a truck from a local car dealership and drove it head on into another vehicle. The car dealership will be responsible for paying 20 percent of the damages, the jury ruled.

Early morning and icy roads equal problems

Today, March 27, 2011, is a perfect example for here in Colorado Springs the icy roads caused by overnight snowfall – up to 4 inches in northern neighborhoods – prompted Colorado Springs police to go on accident alert just before 6 a.m. Wednesday.

When the police go on accident alert, those involved in an accident are advised to exchange information and call police to be called to the scene only if there are injuries, if alcohol or drugs were involved, or if public property, such as a street light or traffic sign, has been damaged.

Drivers should exchange insurance information and report the accident later. Still, when in doubt, call the police.

Army Vet Survives Motorcycle Crash on Tollway

A soldier returned to North Texas from Iraq only to end up in a fight for his life after he was involved in a motorcycle crash on a tollway in the Dallas, Texas area.

The driver of an automobile slammed into the soldier from behind while the soldier was on his way home from work. A vido from a tollway traffic camera shows the drive or a SUV swerving to avoid running over the motorcyclist and he was issued three traffic citations: not having a driver’s license, having no insurance, and failure to maintain speed.

Drunk’s take notice – It is never your fault

Mitchel Anderson, age 42, was not bright enough to understand that getting into a car driven by a drunk drive was a bad idea.

After getting drink, he chose to get into a car with two other drunks — one of whom was driving.

Anderson was riding around with his drunken friends on Fountain Boulevard just more than a year ago when cops pulled them over. The driver was arrested on suspicion of drunken driving after failing his roadside tests.

In what should be considered a merciful decision, cops told Mitchel and the other drunken passenger to take a walk. They had no probable cause for arresting them, so sending them away on foot was logical. Society expects able-bodied adults to manage their own transportation needs.

The walk didn’t go so well for just about an hour after it began, Mitchel stumbled in front of an oncoming car. His injuries were severe. He lost his left leg above the knee and was in a coma for 30 days. It’s fair to pity and pray for Mitchel, but we must also acknowledge that stuff like this happens to people who get too drunk in public. It is just a good thing Mitchel was on foot, and not at the controls of a car.

Whoever hit Mitchel should probably sue him. For it was Mitchel’s s poor decisions that caused him to act stupidly. As a result, some innocent driver has to go through life with memories of a traumatic collision that brought severe pain and suffering to a pedestrian.

Mitchel now says the public owes him. and, incredibly, is suing. He has filed a federal lawsuit against the police department and the two officers who turned him loose on a walk.
