A California man has been awarded $6.4 million in a lawsuit against the city of Roseville, Calif. and a Metro bus company for an injury he suffered while getting on one of the company buses in 2008. The quadriplegic man was being lifted up into one of the buses when his wheelchair rolled back off the platform, causing his head to strike the pavement, the suit stated. The man suffered severe brain injuries as a result. The city will pay 17 percent of the damages and MV Transportation, which operates the paratransit system and MetroAccess, will cover the other 83 percent.

A lawsuit has been filed against the California highway agency Caltrans over hazardous road conditions on the Pacific Coast Highway that caused four bicyclists to crash and suffer serious injuries. The suit claimed the construction area was not marked and the riders were given no warning of the changing road conditions. The plaintiffs suffered “everything from severe cases of road rash to concussions, broken bones, punctured lungs, even paralysis” in the crash, the suit states. The suit is seeking unspecified damages.

A California jury found Caltrans 31 percent responsible for a 2003 mudslide that killed 14 in a local church. The jury will decide this week how much the agency must pay to settle the suit. The suit, filed by the church, claimed Caltrans “created an unnatural diversion of floodwater, which created substantial debris flows onto slopes below the highway that fueled the deadly mudslide.” St. Sophia Greek Orthodox Church settled a suit with the families of the victims in 2008 for $13 million.

A recall of 5 million cans of certain Similac-brand powder infant formulas has been issued over beetles and beetle larvae found in some of the cans. The FDA has announced that ingesting the beetles poses no serious health risks, but that infants could experience gastrointestinal discomfort. The recall affects only the Abbott powder formulas, not the liquid versions.

A California nursing home group has agreed to pay $50 million to settle a lawsuit accusing them of failing to adequately staff their numerous homes across the state. The group was found guilty of failing to meet the state requirements of maintaining 3.2 nurses per patient per day.

A stun-gun manufacturer has agreed to a $2.85 million settlement with a California man who suffered brain damage after being tased four years ago. The man was shocked by a Watsonvile, Calif., police officer in 2006 after refusing to exit a bus. The suit says the man went into cardiac arrest and stopped breathing for 18 minutes after being tased. He suffered severe brain damage, and now requires around-the-clock care, the suit claims. The settlement money will go toward the man’s past and future medical costs.

A lawsuit has been filed against the Salt Lake City International Airport by a woman who slipped and fell and suffered brain damage. The woman, a former flight attendant, said she was walking to her car when she slipped on a slick sidewalk, falling and hitting her head. The lawsuit says the brain damage she suffered has affected “her work and personal life.”

A lawsuit has been filed against Greyhound in Sacramento, Calif., by six passengers injured in a fatal bus accident last week. The lawsuit claims that the driver “did not not fulfill his duty to transport the passengers safely.” Another passenger, who is not part of the lawsuit, has made statements that he believes the bus driver was speeding just before the accident occurred, which killed six people. The accident is still under investigation, and the speed of the bus has yet to be determined. The lawsuit seeks unspecified damages.

A lawsuit has been filed against the Los Angeles Police Department that claims they failed to investigate a 1986 murder since the prime suspect was another police officer. The suit, filed by the family of the victim, claims that the officer had confronted and threatened the victim multiple times before she was killed. During the investigation the police officer was never questioned. Recently, however, the case was reopened and the police office was arrested based on DNA evidence. The lawsuit seeks unspecified damages.

A San Diego jury will decide this week if Pizza Hut is liable for a November 2008 accident involving one of their drivers. The accident left a mother and daughter severely injured. According to the lawsuit, driver had a seizure while driving during work, causing her to black out and crash into the car containing the mother and child. The lawsuit claims that Pizza Hut should have known that their employee was at risk for seizures and has the responsibility of putting safe drivers on the road. The driver was eventually dropped from the lawsuit.
