Police say the man had crashed through a gate at the high school at dawn one morning and the officer opened fire, fearing for the safety of himself and the daughters of the victim, who were in the car. The suit, however, says the man was unarmed and made no movements, gestures or noises that would suggest to the deputy he was dangerous.</div>
